FTC Seeks Comments on CAN-SPAM Changes
ClickZ reports that America's Federal Trade Commission (FTC) is seeking comments on five proposed changes to the CAN-SPAM act. The intent of the changes is supposed to be for the FTC to clarify the CAN-SPAM law for senders and enhance protection for receivers. Here's a quick summary of the five changes proposed by the FTC: 1. If more than one advertiser or service provider is involved, the one who controls the content, determines who the email is sent to, and is in the "from" line will be considered by the FTC to be the sender. If more than one advertiser meets any of those criteria, the CAN-SPAM change would consider the additional ones to be additional senders. 2. Another CAN-SPAM change would clarify whether it's okay to use a Post Office box or private mailbox as the sender's physical address. 3. The FTC's third CAN-SPAM change would require the sender to unsubscribe someone within three days of being notified, rather than the current ten days. 4. The fourth CAN-SPAM change would forbid the sender from requiring someone to take any steps other than sending an email or visiting a Web page to unsubscribe. (Were some senders really requiring recipients to pay to unsubscribe???) 5. The FTC's final proposed CAN-SPAM change is supposed to better define the word "person." The FTC will be accepting public comments on the proposed CAN-SPAM act changes by mail or online until June 27, 2005.
